Default The Problem Isn't Google, It's The Courts

By now, we've all seen the criticisms of Google. There's the accusation that they're stifling free speech from conservatives. The anti-Capitalist left wing is charging them with being a monopoly. There's truth in both those opinions.

It's true that Google (Alphabet, it's parent company) seemed to attack conservatives by demonetizing prominent and relatively innocuous conservative Youtubers. They fired a young man for daring to bring up that biological sexual differences may play a role in why women aren't pursuing tech careers at the same rate as men. Google also seems to want to control what information is available and thereby participate in that hateful practice of social engineering. Most hilariously, Google search engine results for "American inventors" in English returns it's top results a line up of inventors that seem to have been chosen for not being white. About 70% are People of Color. The same result in Spanish or other languages returns a much more prominent and influential list of mostly white males.

The Anti-Capitalist left also makes a credible accusation of Google behaving as a monopoly along with Amazon, Facebook, Apple and Microsoft. Google actually asserted pressure on a think tank it sponsors to remove a prominent member from the think tank advocacy group for his opinions on Big Tech and monopolies. That was certainly in Google's self interest but it's hardly characteristic of being open minded. The move also has a chilling effect on think tanks that really are trying to research and suggest policies that might create a more level playing field for small and mid sized businesses. Furthermore, Google is big enough that it can simply crush rival start ups rather than deal with the changing needs of its customer base. That should alarm anyone who cares about fair business practices.

However, the real problem both the left and the right have with Google is at root, a problem created by the judicial rulings.

Since the passage of the Civil Rights Act of 1964 under Lyndon Baines Johnson, Title VII has only grown more robust and the fear of lawsuits has created an entire industry in and of itself. The Civil Rights Act of 1964 doesn't contain the words "Sexual Harassment" but it does forbid sex based discrimination in the work place. Since then, it has also been interpreted to prohibit discrimination based on sexual orientation in the workplace. Today, at least for the last two years, it's also been interpreted to prohibit gender identity discrimination. It also covers all discrimination based on race, national origin and religion.

The first lawsuit Williams V Saxbe was litigated in 1976 under Title VII. That lawsuit made it official that quid pro quo behavior that involves sexuality is considered sexual harassment. In the years that followed, sexual harassment complaints to the Equal Employment Opportunity Commission (EEOC) rose by thousands. In some recent years, the number of cases reported and/or filed is in the tens of thousands. All of which could generate lengthy court battles, negative media attention, spark Federal Investigations and end up costing businesses millions in fees, compensation, lost productivity and of course, payouts.

In the decades following Williams v Saxbe, the scope of what constitutes sexual harassment and discrimination has also expanded. Williams V Saxbe ruled against a quid pro quo but in judicial rulings since, sexual harassment can be anything that is annoying, alarming or abusive. If you don't remember it, one of the most famous cases was when a secretary of a senior executive was told a joke from the TV show Seinfeld by the executive. She sued and was awarded millions. The executive was fired and sued on account of wrongful termination and was also awarded millions. In this sort of environment, businesses and corporations have to be extraordinarily aware of what constitutes sexual harassment and job discrimination and act proactively to prevent it, since the business is viewed as being at fault rather than the individual employee that discriminates.

If you've ever wondered why every job you've ever had in the corporate world necessitates sensitivity training, it's because the corporation is trying to prove that it's taken any and all measures to prevent harassment and discrimination. It's the only way they have of defending themselves in a court of law.

So what does this have to do with Google and other Big Tech corporations? The tech world is dominated by men and generally by white men. Around 80% of Google's employees are white men. As we all know from experience, the techie nerds and geeks aren't really known for having stellar social skills. Many women deride such men by labeling them as autistic whether they are or aren't. I also don't think it's a big secret that women are more emotional than men. So, the tech world is composed of a lot of men who aren't as sensitive to feelings as much as they are to code. It's also composed on average of about 10-20% of women who are working in an environment dominated by men, who probably don't always understand their female co-workers.

Now, let's think about this in terms of the "ghetto lottery". The term may be insensitive but the strategy is real, whether or not it actually happens in inner cities or elsewhere. The strategy of the ghetto lottery is to cash in by suing a wealthy person or corporation for discrimination against a protected class and thus cashing in because the target of the lawsuit would rather settle out of court.

The Tech world is a ripe for the taking by the ghetto lottery strategy. The very existence of the sex based lopsidedness
combined with the ever expanded list of what constitutes legal discrimination staffed by a bunch of men who aren't particularly adept at social interactions is just a nightmare waiting to happen.

So why is Google so authoritive? So against Free Speech? It's a product of decades of discrimination and harassment lawsuits that make Google a wonderful place for the far left to push a most extreme version of identity politics. They have a lot to lose and the far left base controlling them out of necessity have to believe, really believe, in the oppression Olympics because if they don't, they're going to lose it all in a discrimination lawsuit.

The real question is what does this mean for our culture. Must every one of us be forced into paying homage to the politics of identity and being forced to believe the idiocy all this entails? According to the corporations and courts, yes. If we don't buy into this ridiculousness, not matter how extreme, we better be good at acting as if we do. The schools system in the U.S. even the colleges and universities are buying into this silliness as well because they have taken a similar trajectory based on anti-discrimination and anti-bullying lawsuits.

If we want to create a more free, prosperous and open America, it isn't going to be by shouting down the other side. It's got to come from either the courts recognizing that unequal outcomes aren't always or even often the result of discrimination. That doesn't seem likely. The second method of turning this madness around may have to come from Congress passing anti discrimination legislation that reins in the wild and ever expanding judicial interpretations of what constitutes discrimination.

Either way, the ideological domination of viewing everything always from the viewpoint of identity politics needs to end. Either the courts or congress have to act or we're going to end up in a situation that is culturally unsustainable. We're going to eat ourselves up if this climate of hostility continues.

I watched the interviews with Stefan Molyneux and Dave Rubin.

I truly believe him when he says he thought he was helping Google with the document. What he didn't understand, is that the very fact of pointing out that women may not be as interested in tech careers cannot ever be allowed at any tech company that's rolling in the dough and has a workplace dominated by men.

btw, I think he's right. I don't think women are as good at the stem fields as men. That I even have to state this as an opinion when we all know it's true, is just so silly.

I don't know about that yet. Look, I'm not going to defend Google because they made themselves the Reek for the far left's identity politics but honestly, right now, I have more trust in them because I know they're pushing a far left narrative about race, sex etc. I know they're biased that way and adjust my thinking about them and their stuff accordingly.

I'm more wary of what Congress might do. They're a do nothing Congress but if they get their claws into something they think is going to buy them brownie points with leaning left constituents, they might go hog wild and end up destroying the economy like Obama did. I don't want Congress to act because I don't trust them. I really don't want the courts to either because I think judges think they have good judgement. Judges are the ones who got us into this mess and they have very little understanding of what average Americans are experiencing. The last people who should try to be the cultural deciders are judges, they either see the worst of us in criminal courts or they're so aligned with the SJW crusade they can't even see straight.

I'm not against any lawsuit that punches Google at this point. I'm just not necessarily advocating for it......yet.

It's a conspiracy. The internet giants are working with the government on this. They're being intolerable, doing intolerable things like censoring people based on their political leanings... and they're doing it so people will beg the government to control the internet.

We all know the government want control of the internet. It's the biggest danger to governments all over the world. They eventually need to control it. This is how they're going to do it - by getting us to beg them to do it.
